Many times a homeowner dies without a will. In order for the home to legally be transferred to the heirs, an Heirship Deed must be completed.
To understand an Heirship Deed you must first understand the term, "Affidavit of Heirship." An Affidavit of Heirship is a sworn statement of facts concerning one's family history, genealogy, marital status, and the identity of the heirs of the decedent. It is used to identify who inherits property according to the Probate and Property Codes.
After the Affidavit of Heirship is created, the heirs can then legally deed the home into their possession.
